Krešimir Ivančić

Krešimir Ivančić was born in 1963 in Pakrac, but he spent all of his life in a village near to Daruvar, called Vukovije. In September 1991 he volunteered for the Croatian Army. He was wounded twice during the war, once seriously. In 1994, together with another seven civilians, his father was killed in Batinjska Rijeka by members of a Serb paramilitary unit. The county office of the State Attorney in Bjelovar in 1994 brought a case against the suspects for the crime of terrorism. In 1996 the indictment was legally characterised as a war crime against the civilian population. The trial did not proceed because the accused were out of the reach of the Croatian judiciary. In 2006 Krešimir Ivančić and his sister brought an action of compensation for non-material damage. In 2008, the Bjelovar County Court confirmed the first instance ruling of the Daruvar Municipality Court by which Krešimir Ivančić and his sister were found entitled to 105 000 Kuna each, but in 2010 the Supreme Court of the Republic of Croatia overturned the decisions of the courts in Daruvar and Bjelovar and it refused their claim citing invalidity based on the statute of limitation. After that, Krešimir Ivančić and his sister filed a complaint with the Constitutional Court of the Republic of Croatia. They lost the case and were ordered to pay back the compensation previously awarded to them and to cover the legal costs.
